Repair Authorization & Service Contract
Action Motorsports may inspect, diagnose, disassemble as needed, and repair the vehicle/equipment (the “Vehicle”). By authorizing service, you represent you have lawful authority to approve repairs and authorize us to photograph, move, test-operate, and collect diagnostic data from the Vehicle.
Payment. You agree to pay for parts, labor, taxes, shop supplies, diagnostic time, towing, parking, and/or storage (collectively, “Repair Costs”). A final invoice will list all charges and any credits. Payment in full is required before release of the Vehicle.
Repair Process. (a) Damage Analysis: Our repair plan and cost analysis are based on professional judgment; standardized time units on estimates are not clock hours. Insurer estimates are for insurer purposes only and do not control proper repair method or cost. (b) Additional Damage: Hidden/added damage may require supplemental procedures, parts, and costs; we will notify you and may issue a supplement or revised plan.
Insurers. We determine proper repair methods. We may coordinate with an insurer as a courtesy, but coverage decisions belong to the insurer and any shortfall is your responsibility.
Possession & Lien. We have a possessory lien and may retain the Vehicle until amounts due are paid. You agree to pay reasonable costs, including attorneys’ fees, related to possession actions. Do not transfer ownership/title until Repair Costs are paid in full.
Cancellation / Expectancy. If you cancel after authorization, we are entitled to reasonably expected Repair Costs (e.g., ordered parts, reserved/performed labor, towing, parking, storage) plus applicable interest as permitted by law.
Parts. We prefer new OEM parts when feasible. If safe alternatives are used, they may affect value, lease/finance terms, or manufacturer warranties.
Workmanship Warranty. Workmanship is warranted against defects for 30 days from the date of completion. We will correct workmanship defects at no charge within a reasonable time after notice. Parts are covered by manufacturers’ warranties, if any.
General. Binding on successors/assigns; if any provision is unenforceable, the rest remains effective. Governing law is the state where the repair is performed. This is the entire agreement and may be modified only by a signed writing.
